Please read these Terms and Conditions carefully before placing an order. By using this website, accepting a quotation, submitting an order or purchasing goods or services from Compressed Air Systems UK, you agree to the applicable parts of these terms. Nothing in these terms affects the statutory rights of a consumer.

Terminology

Definitions

  • Business Customer means a person or organisation purchasing wholly or mainly for its trade, business, craft or profession.
  • Consumer means an individual purchasing wholly or mainly for purposes outside their trade, business, craft or profession.
  • Customer, you or your means the person or organisation purchasing or using our goods or services.
  • Goods means products, machinery, parts, accessories, consumables or other items supplied by us.
  • Services means installation, commissioning, servicing, repair, maintenance, inspection, breakdown assistance, consultancy or related work.
  • Special-order Goods means goods ordered, manufactured, imported, modified or configured specifically for a customer.
  • Website means tanaircompressors.com and associated online services operated by us.
  • We, us or our means Compressed Air Systems UK.

Application

Scope of These Terms

These terms apply to use of our website and to contracts for goods or services supplied by us, unless different terms have been agreed in writing.

A quotation, order acknowledgement, specification, project document, warranty document or service agreement may contain additional terms. Where there is a conflict, the more specific written terms will apply to that order or project.

Consumers: Nothing in these terms excludes your legal rights in relation to goods that are faulty, not as described or not fit for purpose, or services not provided with reasonable care and skill.
Business Customers: You confirm that the person placing or approving an order has authority to bind the purchasing organisation.

Where These Terms Apply

Sales Channels, Quotations and Advertising Platforms

These Terms and Conditions apply, where relevant, to goods or services offered, ordered or supplied through any of our sales channels, including:

  • our website and online checkout;
  • sales quotations, estimates, proposals and order acknowledgements;
  • proforma invoices and invoices;
  • orders placed by email or telephone;
  • customer purchase orders;
  • trade-counter and collection orders;
  • eBay and other online marketplaces;
  • social-media platforms;
  • online advertising and product-listing platforms; and
  • any other method through which we offer or agree to supply goods or services.

Quotations and Resulting Orders

Where a quotation, proposal, proforma invoice, order acknowledgement, email or other sales document refers or links to these Terms and Conditions, these terms form part of any resulting contract.

Acceptance may occur by signing or approving a quotation, issuing a purchase order, making a deposit or other payment, confirming acceptance by email or telephone, or instructing us to begin work or procure goods.

Any product-specific terms, technical requirements, prices, exclusions, lead times, payment arrangements or other conditions stated in our quotation or order acknowledgement will also apply. Where there is a conflict, the specific written terms in the quotation or order acknowledgement will take priority over these general terms.

Terms printed or referred to in a customer purchase order will not replace or amend our terms unless we expressly agree to the change in writing.

Online Marketplaces

Purchases made through eBay or another third-party marketplace are also subject to the applicable marketplace rules, buyer protections, payment requirements and policies.

Where a mandatory marketplace policy conflicts with these Terms and Conditions, the marketplace policy will take priority for that transaction. These terms continue to apply to matters not covered by the marketplace policy, provided they do not conflict with statutory rights or mandatory platform rules.

Advertisements and Product Listings

Product advertisements, marketplace listings, social-media posts, catalogues and promotional materials are invitations to place an order and do not themselves constitute acceptance of an order or a binding offer by us.

All products remain subject to availability, verification of price, specification, delivery requirements and formal acceptance by us. Photographs and promotional descriptions are illustrative and should be read alongside the full listing, quotation, order acknowledgement and these Terms and Conditions.

Online Access

Use of Our Website

You may use our website only for lawful purposes. You must not:

  • attempt to gain unauthorised access to the website, server or connected systems;
  • introduce viruses, malicious code or other harmful material;
  • scrape, reproduce or systematically extract website content without permission;
  • submit false information or impersonate another person;
  • use the website for fraudulent or unlawful activity; or
  • reproduce our product information, photographs or branding for commercial use without written permission.

We may suspend, alter or withdraw any part of the website where reasonably necessary. We do not guarantee uninterrupted availability or that the website will always be error-free.

Specifications

Product Information and Suitability

We take reasonable care to ensure product descriptions, photographs, dimensions, specifications, performance information and prices are accurate. Manufacturers may alter specifications, designs, packaging or components without notice.

Images are illustrative and may not show every component, fitting, accessory or configuration included.

Airflow, pressure, power, energy-saving, noise, capacity and performance data are normally based on manufacturer test conditions. Actual performance depends on installation, environment, pipework, maintenance, operating pressure and usage.

Energy-saving percentages, payback periods, ROI calculations and running-cost estimates are illustrations based on stated assumptions and are not guarantees of future savings.

Customer Selection

You are responsible for checking suitability for the intended application, voltage, phase, pressure, airflow, connection size, environment and duty cycle. Our recommendations depend on the accuracy and completeness of information supplied by you.

Charges

Prices and VAT

Website prices may be displayed excluding VAT and including VAT for convenience. The basket, checkout, quotation or invoice will identify the VAT payable.

Unless stated otherwise, prices exclude delivery, installation, commissioning, lifting, electrical work, pipework, civil works, parking, permits, accommodation and other site-specific costs.

Prices may change before a contract is formed. After acceptance, a price may change only where:

  • you request a change;
  • additional goods or work are approved;
  • information supplied was inaccurate or incomplete;
  • a quotation expressly permits adjustment for supplier, currency, duty or tax changes; or
  • there was an obvious pricing or typographical error.

Commercial Offers

Quotations

Unless otherwise stated, quotations are valid for 30 calendar days and may be withdrawn before acceptance.

Quotations are based on information available at the time and may remain subject to availability, technical review, site survey, credit approval and confirmation of final specification.

Drawings, layouts, calculations and technical documents remain our intellectual property unless agreed otherwise in writing.

Commercial Information

Each quotation may state transaction-specific details including prices, VAT, delivery charges, lead times, warranty arrangements, payment terms, finance requirements, exclusions and validity. Those details apply to the relevant quotation and resulting order.

Unless otherwise stated, quotations are valid for 30 days from the date of issue. Prices are net and exclude VAT unless expressly stated otherwise.

Estimated dispatch and delivery dates are not guaranteed and may be affected by supplier availability, manufacturing schedules, finance approval, transport disruption and other circumstances outside our reasonable control.

Contract Formation

Orders and Acceptance

An order submitted through our website, by email, telephone, purchase order or another method is an offer to purchase. An automated acknowledgement is not acceptance.

A binding contract is formed when we:

  • send a formal order confirmation;
  • accept payment against a proforma invoice;
  • dispatch the goods; or
  • begin providing the agreed services,

whichever occurs first.

We may decline or cancel an order before acceptance where goods are unavailable, information or pricing is incorrect, payment fails, delivery is not reasonably possible, restrictions apply, or fraud or misuse is suspected.

Business purchase orders: Terms printed on a customer purchase order will not apply unless expressly accepted by us in writing.

Settlement

Payment

Payment terms will be stated at checkout or on the quotation, proforma invoice, order confirmation or account agreement.

Unless credit terms have been agreed in writing, payment must be received in full before goods are dispatched, collected or ordered from our supplier.

Where payment is by Proforma Invoice, the Proforma Invoice must be issued before payment is taken. Payment may then be made by bank transfer or, where available, by debit or credit card over the telephone.

Goods will not be released, dispatched or made available for collection until cleared funds have been received, unless we have agreed otherwise in writing.

Deposits or staged payments may be required for special-order goods, machinery, installations and project work. Deposits linked to costs already committed may be non-refundable to the extent permitted by law.

Late business payments: We may suspend further supply and exercise statutory rights to claim interest, compensation and reasonable recovery costs on overdue undisputed sums.

Credit Options

Finance

Finance is subject to status, eligibility, affordability checks, lender approval and separate lender terms. Rates, periods and total amounts payable may change.

We do not guarantee finance approval. Unless stated otherwise, the finance agreement is between you and the relevant lender or finance provider.

Where finance is being used, an order will be processed only after finance has been approved and all necessary documents, authorities and customer information have been completed.

We may require company billing details, a purchase order number where applicable and written confirmation of finance approval before issuing an Order Acknowledgement or confirming an estimated delivery schedule.

Lead Times

Stock, Availability and Back Orders

Stock information and estimated availability are provided in good faith but may change before an order is accepted. Goods shown as in stock may be held at our premises, a supplier warehouse or an external distribution location.

Back-order, pre-order and expected-date information is an estimate unless we expressly guarantee a date in writing.

  • Tanair products temporarily out of stock are often available within approximately 10 days.
  • Certain FPS group brands and PCL products may typically require approximately 4–6 weeks.
  • Some seasonal products may have substantially later manufacturer availability.
  • A product-specific date shown on the product page takes priority over general guidance.

Where goods have different lead times, we may hold the order until complete or offer split delivery. Additional delivery costs may apply where a customer requests separate consignments.

Fulfilment

Delivery

Delivery availability, charges and estimated timescales will be shown at checkout, stated in a quotation or confirmed separately. A delivery service description relates to transit after dispatch and does not necessarily mean that an item is currently in stock.

Free delivery may apply to eligible orders over £250 to qualifying UK mainland addresses. Exclusions may apply to heavy, oversized, palletised, hazardous, remote-area, offshore or supplier-direct goods.

Access and Unloading

You must provide a safe, suitable and accessible delivery point. Unless expressly included, delivery is to the nearest safe kerbside or accessible unloading point and does not include positioning, lifting, installation or packaging removal.

You must disclose restricted access, stairs, narrow roads, weight limits, security procedures, limited turning space and other relevant site restrictions before ordering.

Forklifts, cranes, tail lifts, HIAB vehicles and unloading labour are not included unless confirmed in writing.

Failed Delivery

Reasonable storage, return and redelivery charges may apply where delivery fails because nobody is available, details are incorrect, access is unsafe, unloading facilities are absent or delivery is refused without lawful reason.

Trade Counter

Collection

Collection may be available by prior arrangement from 15 Fortnum Close, Kitts Green, Birmingham, B33 0LG.

Do not travel to collect until we have confirmed that the goods are ready. Identification, an order number and authority to collect may be required.

The customer is responsible for a suitable vehicle, safe loading arrangements and effective load restraint. We may refuse loading where the proposed transport method appears unsafe.

Property

Risk and Ownership

Consumers

Risk passes when the goods come into the physical possession of the Consumer or a person nominated by the Consumer.

Business Customers

Risk passes on delivery, collection or transfer to the customer’s nominated carrier. Ownership does not pass until we receive payment in full for the goods and all other overdue sums.

Until ownership passes, the Business Customer must keep the goods identifiable, safely stored, protected, insured and free from altered or removed identification marks.

Delivery Checks

Inspection, Damage and Shortages

Inspect goods as soon as reasonably possible. Visible damage, missing packages or mishandling should be recorded on the carrier documentation and reported promptly with photographs.

Business Customers: Visible damage or shortages should normally be reported within 48 hours. Hidden damage should be reported promptly after discovery. This helps us pursue the carrier and does not remove liability where it would be unlawful to do so.

Retain the goods and all packaging while a claim is investigated. Do not install, dismantle, repair, alter or dispose of affected goods without our agreement unless necessary to prevent immediate danger.

Distance Sales

Consumer Cancellation Rights

This section applies only to Consumers where the contract was concluded online, by telephone or through another distance-selling method.

For most eligible goods, a Consumer may cancel from the date the contract is formed until 14 days after the day the goods are received.

To cancel, send a clear statement to [email protected] before the cancellation period expires.

Goods must normally be returned within a further 14 days. Unless goods are faulty or incorrectly supplied, the Consumer is responsible for direct return costs.

Machinery, receivers, compressors and palletised products may be expensive to return. Please contact us before ordering for an indication of likely return transport costs.

Condition and Handling

Consumers may inspect goods as they reasonably could in a shop. A lawful deduction may be made where handling beyond that has reduced value. Installation, wiring, commissioning, fluid filling, modification or operation under load may reduce value.

Exclusions

Cancellation rights may not apply to:

  • goods made to specification or clearly personalised;
  • bespoke or specially manufactured machinery;
  • goods inseparably mixed after delivery;
  • sealed hygiene-sensitive goods once unsealed;
  • services fully performed following an express request and acknowledgement; or
  • other legally excluded goods or services.

Describing goods as a special order does not by itself remove statutory rights.

Refunds

Refunds will be made within the period required by law. Standard outbound delivery may be refundable, but premium delivery upgrades are not normally refundable beyond the least expensive standard delivery option.

Commercial Orders

Business Customer Cancellations

Business Customers do not have an automatic 14-day cooling-off right. Accepted orders may be cancelled or changed only with our written agreement.

Where cancellation is accepted, the customer must pay reasonable losses and costs, including:

  • supplier cancellation or restocking charges;
  • goods ordered, manufactured or allocated;
  • design, engineering and administration already completed;
  • labour, travel, accommodation, transport or equipment booked; and
  • loss in value or other direct losses reasonably caused.

Special-order, bespoke, modified, imported or customer-specific goods may not be cancellable. A stated cancellation charge, including one of up to 45%, applies only where reasonable and reflective of costs, commitments or losses. A separate supplier restocking charge of up to 45% of the net goods value may also apply to an authorised non-faulty Business Customer return, as explained in the Returns Procedure section.

Authorisation

Returns Procedure

Goods must not be returned without prior authorisation from us.

Contact us before returning anything so we can confirm the correct address and return instructions. Some goods must be returned directly to a manufacturer or distribution centre.

Unless faulty or incorrectly supplied, returned goods should be:

  • complete and in resaleable condition;
  • unused, except for reasonable Consumer inspection;
  • in original packaging where reasonably possible;
  • securely packed;
  • accompanied by manuals, accessories, fittings and free items; and
  • marked with the return details provided.

Non-Faulty Business Returns and Restocking Charges

Business Customers do not have an automatic right to return non-faulty goods. Any such return requires our prior written authorisation and acceptance is entirely at our discretion.

Where we agree to accept a non-faulty return, the Business Customer is responsible for all reasonable costs arising from the return. These may include collection, transport, inspection, testing, repackaging, administration and any restocking or cancellation charge imposed on us by the manufacturer or supplier.

A restocking charge of up to 45% of the net goods value may apply where this reflects the charge imposed on us by our supplier or the reasonable loss and costs arising from the return. The applicable charge will be confirmed before the return is authorised.

Special-order, bespoke, modified, imported, made-to-order or customer-specific goods may not be returnable. Goods that have been installed, commissioned, used, altered, damaged or removed from their original packaging may also be refused or subject to an additional deduction where lawful.

Consumers: This business restocking provision does not apply to statutory cancellation rights or to goods that are faulty, incorrectly supplied, not as described or otherwise subject to a statutory remedy. Where legally permitted, a deduction may be made only for diminished value caused by handling beyond what is reasonably necessary to inspect the goods.

Claims

Faulty, Damaged or Incorrect Goods

Contact us promptly if goods are faulty, damaged, incorrectly supplied or materially different from description.

We may request:

  • the order or invoice number;
  • model and serial number;
  • photographs or video;
  • a description of the fault;
  • installation, commissioning and maintenance records;
  • safe electrical or pressure readings and fault codes; and
  • reasonable access for inspection or remote diagnosis.

Stop using any product that appears unsafe and isolate it where safe. Do not attempt repairs unless competent and authorised.

Depending on the circumstances and legal rights, we may inspect, repair, replace or refund. No credit will be due where the issue results from incorrect installation, misuse, unsuitable supply, contamination, poor maintenance, wear and tear or unauthorised alteration.

Product Protection

Warranty

Warranty periods and conditions vary by product and manufacturer. Check the product page, quotation, invoice, warranty document or manufacturer terms.

Unless a longer period is stated, machinery and components may be supplied with a 12-month warranty. Certain pumps and products may carry a different or extended manufacturer warranty.

Manufacturer warranties are normally administered on a Return to Base basis unless otherwise agreed in writing. The customer may be required to return the affected item or component to the address we specify for inspection, testing, repair or replacement.

Consumers: A Return to Base manufacturer warranty does not restrict your statutory rights or require you to bear costs which the law requires us to meet.

Warranty may depend on:

  • correct installation and commissioning;
  • operation within specification and duty cycle;
  • correct voltage, phase, isolation and protection;
  • servicing at required intervals;
  • use of approved oils, filters, parts and consumables;
  • maintenance of service records; and
  • prompt fault reporting.

Warranty does not normally cover:

  • routine service items, adjustments, oils, filters, belts and consumables;
  • normal wear and tear;
  • incorrect installation, wiring, voltage or phase;
  • misuse, overloading, overheating or operation outside specification;
  • water, oil, dust, chemical or other contamination;
  • corrosion, frost, flooding, fire or environmental damage;
  • unauthorised modification or repair;
  • failure to follow instructions or maintenance schedules; or
  • business interruption, downtime or substitute equipment costs, except where liability cannot lawfully be excluded.

Any warranty is additional to a Consumer’s statutory rights.

Site Works

Installation, Commissioning and Site Requirements

Installation and commissioning are included only where expressly stated in writing.

Standard quotation exclusions: Unless specifically listed as included, quotations exclude installation and commissioning, electrical installation, pipework, additional accessories or optional extras, and building or civil works.

Any additional works, goods or services required outside the agreed quotation scope will be advised and quoted separately before proceeding, except where urgent work is reasonably required to make equipment or a site safe.

The customer is responsible for ensuring site readiness, including:

  • safe access and a suitable level base;
  • adequate ventilation and environmental conditions;
  • correct electrical supply, isolation and protective devices;
  • appropriate drainage and condensate arrangements;
  • suitable pipework and connection points;
  • lifting access and equipment;
  • permits, inductions and site authorisations;
  • asbestos, hazardous-material and site-risk information; and
  • shutdown and production arrangements.

Electrical work must be carried out by a suitably qualified person. We may stop or postpone work where conditions are unsafe, access is unavailable or the site is not ready. Abortive attendance, waiting, travel, accommodation and rescheduling charges may apply.

Pressure Systems

Unless expressly included, the customer remains responsible for its duties under the Pressure Systems Safety Regulations 2000, including safe operating limits, a Written Scheme of Examination, competent-person examinations, records and maintenance.

Supplying or installing equipment does not by itself mean we accept appointment as the competent person under a Written Scheme of Examination.

Engineering Support

Servicing, Repairs and Breakdown Work

Service and repair work will be carried out with reasonable care and skill based on available information and access.

A call-out fee may cover travel and an initial period on site only. Parts, additional labour, return visits, parking, tolls, accommodation and specialist equipment may be charged separately.

Diagnosis may reveal additional faults. We will seek approval before material extra work, except where immediate action is reasonably necessary to make equipment safe or prevent serious damage.

We do not guarantee first-visit repair, immediate parts availability or that a temporary restoration will constitute a permanent repair.

Emergency Assistance

Our telephone number may be available for 24/7 emergency breakdown enquiries. This does not guarantee immediate attendance, parts availability or resolution. Response depends on engineer availability, location, access, safety and the nature of the fault.

Your Duties

Customer Responsibilities

The customer is responsible for:

  • providing complete and accurate information;
  • checking quotations, specifications and confirmations before approval;
  • ensuring suitability for the intended use;
  • obtaining necessary approvals and permissions;
  • providing a safe site and complying with health and safety duties;
  • ensuring operators are competent and trained;
  • following manuals, warnings and maintenance schedules;
  • checking oil, drains, filters, ventilation and operating conditions;
  • preventing unauthorised access or modification; and
  • maintaining appropriate insurance and business-continuity arrangements.

Compressed air must not be used for breathing-air, medical, food, pharmaceutical, explosive-atmosphere, life-safety or other safety-critical applications unless the complete system has been specifically designed, treated, tested and approved for that use.

Responsibility

Liability

Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • rights that cannot legally be excluded; or
  • any other liability that cannot lawfully be limited.

Consumers

We are responsible for foreseeable loss or damage caused by our breach or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was formed.

Business Customers: Subject to liabilities that cannot lawfully be excluded, we will not be liable for loss of profit, revenue, production, contracts, savings, business, opportunity, goodwill, data, downtime, substitute equipment or indirect or consequential loss. Our total aggregate liability arising from an order will not exceed 100% of the net amount paid or payable for the goods or services giving rise to the claim.

Delays

Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, including:

  • supplier or manufacturer delays;
  • shortages of materials, components, labour, energy or transport;
  • carrier disruption, port congestion or customs delays;
  • industrial disputes;
  • fire, flood, severe weather, epidemic or natural disaster;
  • war, terrorism, civil unrest or sanctions;
  • government action or legal change; and
  • power, telecommunications or internet failure.

We will take reasonable steps to reduce the effect and will contact you where there is a material impact.

Ownership of Content

Intellectual Property

Website text, descriptions, photographs, graphics, videos, logos, calculators, layouts, downloads and software are owned by or licensed to us and protected by intellectual-property law.

“Tanair”, “Tanair Compressors”, associated logos, product names and the slogan “Home of the Air Compressor That Pays for Itself” must not be copied or used without prior written permission.

Reasonable extracts may be viewed, printed or downloaded for personal use or purchase evaluation. Commercial reproduction, republication, sale, modification or distribution is prohibited without permission.

Privacy, Cookies and Communications

Personal information is processed in accordance with our Privacy Policy and cookies are used in accordance with our Cookie Policy.

We may contact you using details supplied in connection with an enquiry, order, delivery, account, warranty claim or service request.

Calls, emails, forms and live-chat conversations may be recorded or retained where lawful for security, evidence, training, customer service and quality purposes.

Contract Administration

General Provisions

Changes

We may update these terms. The version displayed when the contract is formed will normally apply.

Transfer and Subcontracting

We may transfer or subcontract rights and obligations where this does not reduce a Consumer’s legal protection. Customers may not transfer contractual obligations without our written consent.

Third-Party Rights

Unless expressly stated, no person other than you and us may enforce the contract under the Contracts (Rights of Third Parties) Act 1999.

Waiver and Severability

Delay in enforcing a right is not a waiver. If part of these terms is unenforceable, the remaining terms continue to apply.

Entire Agreement for Business Customers

For Business Customers, the contract, quotation, confirmation and incorporated documents form the entire agreement. This does not exclude liability for fraud.

Disputes

Governing Law and Jurisdiction

We aim to resolve concerns promptly and fairly. Please contact us first with the relevant order, invoice or job number.

Consumers

These terms are governed by English law. Consumers may bring proceedings in England and Wales or, where applicable, in the courts of the part of the United Kingdom in which they live.

Business Customers

Business contracts are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction unless agreed otherwise in writing.
